What are Mutual Funds?

Investment funds are variable capital corporations, subject to the supervision, regulation an sanction from the CNBV (National Banking and Securities Commission), which offer the disposal of their shares to the investing public, through a financial broker, for the proceeds to be professionally.

Types of Funds:

  • Equity;
  • Debt securities;
  • Capitals, and
  • Limited scope.

Equity Mutual Funds:

Are those operating with Assets Subject of Investment whose nature corresponds to shares, liabilities, debenture bonds, cash deposits, documents representing a debt payable by a third party and other stock, securities or documents authorized by the CNBV through general provisions.

Mutual Funds in Debt Securities:

Are those operating exclusively with the Assets Subject of Investment whose nature corresponds to stock, securities or documents representing a debt payable by a third party.

Capitals Mutual Funds:

Are those operating predominantly with Assets Subject of Investment whose nature corresponds to shares or social partners, liabilities and bonds payable by Companies Promoted by the investment fund itself.

Limited Scope Mutual Funds:

Are those operating exclusively with the Assets Subject of Investment defined in their articles of association and information prospects to the investors.

Purpose of the Mutual Funds:

Investment funds are meant for the acquisition and customary and professional sale of Assets Subject of Investment with resources from the placement of the shares representing its social capital, offering them to indeterminate persons (Greater Investors), through financial brokerage services.

Objectives of the Mutual Funds

  • Strengthening and decentralization of the securities market.
  • Access for the small and mid-sized investor to such market.
  • The diversification of the capital.
  • Contributing to finance the productive activity of the country.
  • Protecting the interests of the investors.

Legal Basis

The legal structure of the investment funds is provided for in:

  • Investment Funds Act
  • General provisions applicable to investment funds and the people rendering their services to them.
